Last updated: June 2026. By accessing, registering on, playing, or contributing to TheOtServer ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. You must be of legal age in your country, or have the permission of a parent or guardian, to use the Service.

1. What this is

TheOtServer is a free-to-play, fan-made hobby project operated by "TheOtServer" ("we", "us", "the Operator"). It is not affiliated with, endorsed by, sponsored by, or connected to CipSoft GmbH, Tibia, or any related party. All related names, trademarks, and assets belong to their respective owners. We claim no ownership of that intellectual property and make no commercial use of it.

2. No ownership — everything is a license

Your account, characters, OTS Points, and items are a limited, revocable, non-transferable license granted by the Operator. They are not your property, have no real-world or monetary value, and may be modified, suspended, reset, or removed at any time. Accounts and characters remain the property of the Operator.

3. Donations, not purchases

Any payment is a voluntary contribution to help cover server costs and support the project — not the purchase of goods or services. OTS Points received are a thank-you, governed by the Purchase Terms.

4. Provided "AS IS"

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee uptime, performance, data integrity, security, or that the Service will continue to exist. We may change, rebalance, reset, suspend, or permanently shut down the Service at any time, without notice and without liability.

5. Limitation of liability

To the fullest extent permitted by applicable law, the Operator and anyone involved in running the Service shall not be liable for any loss or damage of any kind — including lost characters, items, points, data, time, money, or downtime — arising from or related to your use of (or inability to use) the Service. You use the Service entirely at your own risk.

6. Indemnity

You agree to defend, indemnify, and hold the Operator harmless from any claim, demand, loss, or expense arising from your use of the Service or your violation of these Terms or the Rules.

7. Volunteers, not employees

Anyone acting as staff, game master, or moderator is an unpaid volunteer. They are not employed by, contracted to, or agents of the Operator, and the Operator is not liable for their individual actions.

8. Conduct & enforcement

Use of the Service is subject to the Rules. We may suspend, ban, or delete any account, at our sole discretion, with or without notice, for any reason we consider harmful to the Service or its community.

9. Governing terms

As a free-to-play fan project with no fixed place of business, no specific governing jurisdiction is designated. Any dispute shall first be resolved informally and in good faith. All disclaimers and limitations above apply to the fullest extent permitted by applicable law; if any provision is held unenforceable, the remainder stays in full effect.

10. Credits & licensing

TheOtServer runs on modified Open Tibia server software based on The Forgotten Server, distributed under the GNU General Public License v2 (GPLv2). We gratefully credit its authors and contributors. This is a fan-made project and is not affiliated with them.

11. Changes

We may update these Terms at any time. Material changes will be posted on the website. Continued use of the Service after a change means you accept the updated Terms.
